Rethinking the Legal-Economic Capacities of the Constitution with a Resistive -Participatory Approach (In Light of Good Governance Theory)

An analysis of the economic principles of the Constitution reveals regulations for economic domains fundamentally based on the ideals of self-sufficiency and national independence. According to Article 44 of the Constitution, economic regulations are divided into three sectors: state, cooperative, and private. Contrary to the tendency of governments toward economic centralization and state intervention, the General Policies of Article 44, its executive regulations, and related legislation have taken steps toward privatization, downsizing the government, limiting its intervention, and increasing public participation in the economy. The neglect of the Constitution’s capacities (particularly in the cooperative sector) and, on the other hand, the improper implementation of the mentioned general policies and executive regulations have weakened the potential for strengthening a participatory and resistance-based economy. This research, in response to the question of how the overlooked foresight of the Constitution—with its resistance-participatory orientation—relates to the economic efficiency of subordinate regulations, adopts a descriptive-analytical method with a legal-economic approach. By relying on internal solidarity (participation-centered economy) and rejecting external dependency (economic resilience), it examines the legal capacities of the Constitution in economic domains, as well as subordinate documents and regulations. The study argues that neglecting normative and policy opportunities poses a threat that must be transformed into an advantageous opportunity by integrating sustainability and participatory goals in an endogenous manner, thereby realizing a resistance-oriented and participation-driven economy.

Analyzing the people-fundamental model of educational governance from the perspective of educational jurisprudence

In the current situation, the discussion of the model of educational governance and the role of the people and the investigation of the policy of popularization, crowdsourcing, and sustainable participation in the field of formal education have gained double importance. The author has discussed "people-centeredness in education" in another area. But what is the position of the people in the model of independent educational governance? What is the fundamental nature of this model and the contribution of other actors? Does the fundamentalism in this model negate the sovereign dimension of education and mean de-sovereignty, or de-monopoly or influence of secularization? This article tries to answer the above questions with descriptive and inferential method. According to the investigations, the following results were obtained: 1) Based on the theory of "network of rights and educational tasks", the model of Mukhtar is people-based, and people's acting in education has an inherent and original agency, and according to the "transverse network of educational tasks", the people-based nature of Mukhtar's model is drawn. 2) In the chosen model, the actors of education are placed in the longitudinal and transverse sides of the "province of education" and in a networked manner, and the dignity of "transverse authority in education" means the people-based model of Mukhtar, which is related to the narratives. Post-modern is different from networking. Regarding the internal distribution of educational authority, the longitudinal side of the family and the lateral side of the religious scholars have priority. 3). In the selected model, governance is as an actor among other actors or as an alternative, and the fundamental people of this model does not mean de-governance and de-monopoly of education. 4) As evidence, the fundamentalism of the chosen model does not mean the secularization of education; But as a proof, this possibility cannot be denied

The Ethical Duties of Foreign Representatives of the Islamic Republic of Iran in Modern Public Diplomacy Based on the Statements of Ayatollah Khamenei

Effective foreign policy is one of the key instruments for states to address their needs and achieve their objectives. In this context, ambassadors and foreign representatives, given their residence in the host country and familiarity with diplomacy and its techniques, can play a significant role. Existing research on the duties of foreign representatives has largely overlooked their ethical responsibilities, despite their importance. The data for this study were collected through a library-based review of the speeches and writings of the Supreme Leader and analyzed using a qualitative approach and thematic analysis method. The findings, based on principles such as human dignity and equality emphasized in religious sources, identify various ethical duties for ambassadors. These responsibilities span different domains, including personal, familial, administrative, and international aspects. Consequently, an ambassador must adopt a broad and compassionate perspective toward themselves, their family, embassy staff, and the people of their host country, striving to guide, nurture, and remove obstacles to their moral and intellectual development

Examining the conditions of the Islamic ruler from the perspective of Farabi and Mulla Sadra

The ruler finds meaning within governance, and governing means guiding society’s ship to its intended shore. In this context, the captain, crew, and others aboard the ship move together on a unified path toward a defined goal, all serving and obeying the ship’s captain, who is a skilled, capable, compassionate, and knowledgeable navigator. In a religious society, the ruler manages, organizes, and directs society within the scope of the system’s overall interests, in a way that does not conflict with the rights of individuals and the community. Primarily and inherently, God is the captain of this ship, and secondarily and derivatively, this role is vested in the Holy Prophet Muhammad (peace and blessings be upon him) and the infallible Imams (peace be upon them). Just as a person has absolute authority over all their limbs, so too has Almighty God granted the ruling body absolute authority over all individuals. The Islamic ruler is an exceptional human being who is connected to the higher realms and has attained the level of actualized intellect and intelligible in actuality. Their imaginative faculty has naturally reached its utmost perfection, and in all their states, they are prepared to receive divine grace through the ‘active intellect’ and are under God’s favor. The divine government, under the leadership of the perfect human being, aims to secure the happiness of humanity in this world and the hereafter, making it the ideal government. During the absence of the infallible Imam (peace be upon him), this important task is entrusted to the qualified jurisprudent (Vali-e-Faqih) who is an expert and specialist in religious matters. By recognizing the attributes and conditions of the ruler, the necessity of following them arises

Elucidating the Formative Principles and Methods of Islamic Student Associations Based on the Axiological Foundations of Ayatollah Khamenei's Perspective Abstract

The Islamic Revolution began with the immense organizational endeavor of Imam Khomeini and the formative education of revolutionaries. This blessed, nurturing, and character-building tree entered universities in the form of Islamic student associations. With deep and future-oriented insight, Ayatollah Khamenei has always sought to preserve and comprehensively enhance these character-forging and talent-nurturing entities within universities.Islamic associations, through informal formative education, install the value-based software in individuals and teach students the etiquettes of individual and social life. Therefore, utilizing modern findings in educational sciences is essential for them. The main objective of this research is to extract the most important educational principles and methods of Islamic student associations, based on the axiological foundations of Ayatollah Khamenei's viewpoint. Using a "documentary and qualitative content analysis" method, a purposive sample—including the organizational corpus of Imam Khamenei, as well as the charters and influential organizational works of key figures within the associations—was examined. The related axiological foundations and educational objectives were determined. Through a "deductive" method, the educational principles were specified, and the educational methods were inferred using these principles and findings from educational sciences. Some of the research findings include the following principles and methods: Strengthening Religious Foundation (Methods: Rectification and granting insight, Study, Companionship with scholars, Discussion) Removing Obstacles to Liberating Human Potential (Methods: Correction and guidance, overlooking and guiding unintentional mistakes of members)Value-Based Nurturing of the Elite (Methods: Providing a free field of action, Knowledge-enhancement workshops) Cultivating Advocates of Justice (Methods: Demand-seeking, Promoting a simple lifestyle), Affection and Genuine Dialogue (Methods: Direct dialogue, Intellectual persuasion, Bonding and companionship), Fostering Responsibility (Methods: jihadi camps, Jihad of Explanation) Idealism and Aspiration (Methods: Discourse-building, Instilling hope, "Fire at Will" initiative), Adherence to Guardianship (Wilayat) (Method: Role-modeling) Spiritual Orientation (Methods: Individual self-discipline, Remembrance and repentance, Collective self-discipline), Knowing and Confronting the Enemy (Methods: Granting Quranic insight regarding facing the enemy, A suspicious view towards the enemy's media narrative, Establishing connections with anti-arrogance associations worldwide), It is suggested that to implement the methods of this research, working groups and think tanks be established within the substructure of the associations. By formulating the implementation stages for each method—considering the conditions of each university—educational activities should be carried out step by step

The necessity of relying on the religious guardianship system, an effective strategy in restoring the components of Islamic civilization

Undoubtedly, the alignment of material manifestations and also epistemological dimensions as aspects of civilization with the inherent concepts of the religion of Islam is considered one of the most important indicators of Islamic civilization. Accordingly, and unlike other civilizations, studies in the field of Islamic civilization would not be possible without paying attention to the role of the religious guardianship system. Therefore, the present study, which has been conducted using a descriptive-analytical method, seeks to answer this main question: with what argument should the necessity of relying on the religious guardianship system be emphasized and examined as an effective strategy in recovering the components of Islamic civilization? Referring to divine verses and library sources, the results show; religious guardianship, as the strongest principles of the thinking of an Islamic nation, is considered one of the main strategies in recovering the components of Islamic civilization, along with strengthening the monotheistic attitude and drawing a religious orientation.Furthermore, it is by relying on the religious guardianship that practical unity and theoretical convergence in the Islamic Ummah are realized. Also, by institutionalizing the spirit of legalism, which is a result of the guardianship-based vision, the grounds for implementing divine laws are prepared, and as a result of these civilization-building components, the aspects of Islamic civilization will be strengthened and flourished

Guide to the Origin of Legitimacy of Religious Government with Emphasis on Verses 246 and 247 of Surah Al-Baqarah and the Interpretive Perspective of Allamah Tabatabaei

This research aims to analyze and explain the foundations of the legitimacy of the religious government, based on Allamah Tabataba'i's interpretation of verses 246 and 247 of Surah Al-Baqarah. These verses refer to the Quranic narration of the incident of the people's request for the appointment of a commander for war by the Prophet of the Children of Israel and the divine appointment of Talut as the leader, and from this perspective, they contain a Quranic foundation for analyzing the concept of political legitimacy in the religious community. The qualitative research approach and its method are based on documentary and descriptive-analytical analysis. The main sources of the research are Allamah Tabataba'i's Tafsir Al-Mizan and complementary interpretive sources. The research findings indicate that in Allamah's intellectual system, the legitimacy of the government cannot be justified solely on the basis of public will, tribal affiliation, or material criteria, but rather the divine appointment and will are considered the focal point of legitimacy. At the same time, signs such as having knowledge and executive power as objective qualifications, as well as popular acceptance and support, are considered as conditions for its objective and social realization. This analysis also shows that from the perspective of the scholar, divine traditions in society such as the principle of struggle for survival, choosing the fittest, and following the environment, although they affect social order, find meaning under the auspices of the absolute divine will and wisdom. Accordingly, the desired religious government is a divine-people's government in which the link between political legitimacy and absolute divine guardianship and the conscious choice of the people is established, and this link will guarantee the happiness, good and prosperity of society.

Conceptual model of Resistance Economy in the Holy Quran Using Thematic Analysis

The idea of a resistance economy stems from the continuous economic pressures exerted by the dominant system against the Islamic Republic of Iran. But the basis of that is Islam's concern for economic and livelihood issues, which must be extracted through contemplation of religious texts. The Leader of the Islamic Revolution's order that academics should explain the dimensions and boundaries of the resistance economy in academic language is based on this assumption. the present study In order to answer the question of what are the dimensions and components of the resistance economy in the Quran, attempts to examine the relevant verses and present a Conceptual model of resistance economics in the Quran by using the method of Thematic analysis. After analyzing the data obtained from the verses and interpretive sources, the findings of this research were categorized into 114 key propositions, 232 basic themes, 29 organizing themes, and 6 overarching themes, and the desired model was designed based on them. The proposed model consists of 6 main components: the relationship between security and economy, spiritual valuation of the economy, public participation, economic management, increased production, and the cultural attachment of the resistance economy. Considering the breadth and diversity of its dimensions, it concludes that the resistance economy is not a passive measure against pressures and limited to crisis conditions, but rather, it is the same Islamic economy that always has resistance and attention to requirements in its essence. In this way, just as defense readiness is not limited to wartime conditions but is permanent and one of the necessary commands of Islam, the resistance economy is also an important part of that defense readiness

Political Justice and Its Components in the Thought and Practice of Imam Khomeini (RA) with Emphasis on Gender

Human history is full of a derogatory view of women that has ignored their dignity and presented them as weak, helpless, or at least pitiable beings. In the modern contemporary world, the issue of gender justice and the elimination of discrimination against women has become an issue with important research dimensions. In Islamic countries, the interpretations and opinions of Muslim scholars play a significant role in redefining the role and status of women, because the way women think and the performance of Islamic governments and statesmen depend on the interpretation and understanding provided by Muslim scholars. This article examines the speech, writings, and practical conduct of Imam Khomeini (RA) regarding the true status of women. He is one of the thinkers who have provided significant theoretical and practical breakthroughs in this field. The central question of the present study is how gender political justice is interpreted within the framework of Imam Khomeini's (RA) thought and practice. The method of the present study is qualitative content analysis and has been developed using a questioning framework based on a combination of related theoretical discussions. Initial findings indicate that Imam Khomeini (RA) views the determination of women's roles and responsibilities in the public-political space with an approach aligned with educational-cultural justice and governance efficiency, and emphasizes the alignment between religious values and social-human requirements. This article attempts to provide a brief explanation of the concept of gender political justice from his perspective by carefully explaining the criteria and reference sources and reinterpreting its socio-political consequences.
