موسسه پژوهشی فرهنگی انقلاب اسلامی رهنمون انقلاب اسلامی ۳۰۶۰-۵۶۰۱ 1 2 2024 06 21 The art of jurisprudential reasoning and solving women's issues in the jurisprudential thought of Ayatollah Khamenei فن ‌استدلال فقهی و راهگشایی از مسائل زنان در اندیشۀ فقهی آیت‌الله خامنه‌ای 1 40 198721 10.22034/rir.2024.428243.1013 FA عزت السادات میرخانی عضو هیئت علمی گروه مطالعات زنان دانشکده علوم انسانی دانشگاه تربیت مدرس ، ایران، تهران مهلا ذوالفقاری کیان سطح سه فقه و اصول از حوزه علمیّه جامعه الزهراء (س)، کارشناس ارشد فقه مقارن و حقوق عمومی اسلامی از دانشگاه مذاهب اسلامی 0000-0003-1479-1248 Journal Article 2023 12 02 the result of any science with unknown unknowns in order to discover and act as a vector of unknowns , produce raw and non - relations with each other .these notions are formed after the analysis and discovery of relationships, which the mind establishes to measure the degree of self - affirmations by considering their being truthful and false in accordance with fact and reasoning .the way of reasoning is the bearer of principles and principles , in fact , the principles of logical and accompaniment with support and prior knowledge .therefore , the truth and truth of a reasoning and its method and method of applying it in the arrangement of materials and the preservation of the system in the system of argument (Minors and somptions ) and the correct way of reasoning of arguments , even of imaginary andAcknowledgment .therefore , it is necessary to study the science and practice of science and technology .on the other hand , the vacuum of this issue in the sciences in different sciences has created and makes fallacies and conflicts .accordingly , the necessity of discovering the technique of reasoning in any science and putting it at the attention of the thinkers from among them , to ensure the validity and soundness of the reasoning , the field of science and familiarity with the techniques of Arguments are provided .jurisprudence is no exception to this rule . it can be done by discovering the scientific technique of jurists and to assess the degree of their knowledge , to jurisprudence science and the smell of new in the course of progress and development .in addition to solving the new jurisprudence issues , this will have a significant impact on the basis of jurisprudential thought and strategies .in this article , by content analysis and deductive – interrogation method , while explaining the concept of reasoning and its importance , especially the technique of supreme leader 's reasoning in the field of women issues and the extent of iqbal 's argument in the way of women 's reasoning about the technique of women reasoning in this field.  نتیجۀ مواجهۀ هر علمی با مجهولات با هدف کشف واقع و پرده‌برداری از مجهولات، تولید تصورات اولیۀ خام و بی‌ارتباط با یکدیگر است. این تصورات پس از تجزیه‌وتحلیل و کشف رابطه‌ها، تصدیقاتی را تشکیل می‌دهند که ذهن جهت سنجش میزان علم‌آوری این تصدیقات با توجّه به صادق و کاذب بودنشان در تطابق با واقع به استدلال و استنتاج می‌پردازد. نحوه استدلال نیز خود در تطابقش با واقع حامل ملاکات اصولی و منطقی و ملازم با پشتوانه‌ها و پیش‌دانش‌های عقلی و نقلی است. بر این اساس، صدق و کذب یک استدلال به روش و شیوۀ به‌کارگیری فن آن در چینش مواد و حفظ ملاکات در نظام برهانی (صغریات و کبریات) و میزان درستی در تنظیم ادله حتی اوّلیات تصوری و تصدیقی دارد. ازاین‌رو سنجش فن استدلال و جرح‌وتعدیل عالمانه سهم بسزایی در پیشرفت علوم دارد. از سوی دیگر خلأ این امر دشواری‌هایی را در علوم مختلف ایجاد و عرصۀ مغالطات و تعارضات را فراهم ساخته است؛ بنابراین ضرورت در کشف فن استدلال‌ در هر علمی و قرار دادن آن در معرض سنجش متفکران از ملازمات بین آن است تا با حصول اطمینان بر روشمندی و صحت استدلال، زمینۀ پیشرفت علوم و آشنایی با فنون استدلال‌های صادق فراهم می‌آید. علم فقه نیز از این قاعده مستثنا نیست و می‌توان با کشف فن استدلال‌های فقها و در معرض سنجش قرار دادن میزان علم‌آوری آن‌ها، به علم فقه، در مسیر پیشرفت و ضابطه‌مندی، رنگ و بوی تازه‌ای بخشید. تحقق این امر علاوه بر حل مسائل فقهی نوین، در سنجش بنیان اندیشه‌های فقهی و راهبردهای فتوایی فقیهان تأثیر بسزایی دارد. این مقاله با روش تحلیل محتوا و شیوه‌ای استنباطی- استنطاقی، به تبیین مفهومی فن استدلال و اهمیت آن، به‌خصوص فن استدلال آیت‌الله خامنه‌ای، در زمینۀ مسائل زنان پرداخته و میزان اقبال فن استدلال ایشان را در راهگشایی از مسائل زنان نسبت به فن استدلال سایر فقها در این زمینه بررسی کرده است. https://www.enghelabpajooh.ir/article_198721_3c28efe497c8bbc3c3c34cf46d32986d.pdf
